Terms and Conditions for Maunga Blooms
Welcome to Maunga Blooms! These Terms and Conditions govern your use of our online platform and the purchase of products and services from us. By accessing or using our service, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our service.
1. General
Maunga Blooms operates from: 7 Rimu Street, Suite 102, Rotorua, Bay of Plenty, 3010, New Zealand. Our online platform is designed to provide fresh flower arrangements, bespoke wedding florals, corporate event floral design, plant sales, floral subscriptions, delivery services, and floristry workshops.
- These Terms and Conditions may be updated from time to time without prior notice. It is your responsibility to review them periodically.
- By continuing to use our site after any revisions become effective, you agree to be bound by the revised terms.
2. Products and Services
- Flower Availability: All products are subject to availability. While we strive to ensure a continuous supply of all items, there may be instances where certain flowers, plants, or products are temporarily out of stock. In such cases, we reserve the right to substitute with items of equal or greater value and similar style.
- Product Descriptions: We endeavour to display as accurately as possible the colours and images of our products. However, we cannot guarantee that your device's display of any colour will be accurate.
- Bespoke and Custom Orders: For bespoke wedding florals, corporate event floral design, and custom arrangements, specific terms and payment schedules will be outlined in a separate agreement or quote provided directly to the client.
- Floristry Workshops: Booking for workshops requires full payment at the time of reservation. Cancellation policies for workshops will be clearly stated at the time of booking.
3. Ordering and Payment
- All prices are listed in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) unless otherwise stated.
- Full payment is required at the time of order placement for all standard products and services, including floral subscriptions and plant sales.
- We accept various payment methods as indicated on our online platform.
- Upon successful completion of an order, you will receive an email confirmation.
4. Delivery Services
- Delivery charges are calculated based on the delivery location and will be displayed during the checkout process.
- We endeavour to deliver within the specified timeframes, but exact delivery times cannot be guaranteed.
- It is your responsibility to ensure the accuracy of the delivery address and contact information provided. We are not responsible for delays or non-delivery resulting from incorrect information.
- If the recipient is not available at the time of delivery, our delivery personnel will attempt to leave the flowers in a safe, shaded spot. If this is not possible, the item may be returned to our premises, and re-delivery charges may apply.
5. Cancellations and Refunds
- Cancellations for standard floral arrangements and plant sales must be made at least 24 hours prior to the scheduled delivery or pick-up time for a full refund.
- For bespoke orders and workshops, cancellation policies will be outlined in their specific agreements.
- Due to the perishable nature of our products, we do not typically offer refunds or exchanges for dissatisfaction once an item has been delivered, unless there is a verifiable quality issue reported within 24 hours of receipt. Proof of defect may be required.
6. Intellectual Property
- All content on our online platform, including images, graphics, logos, and text, is the intellectual property of Maunga Blooms and is protected by New Zealand and international copyright laws.
- You may not use, reproduce, or distribute any content from our site without our express written permission.
7. Limitation of Liability
- Maunga Blooms shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services or products.
- We make no warranties, express or implied, regarding the longevity or exact appearance of floral products, given their natural and perishable qualities.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
